The Berkshire Law Office recently won two cases at the Supreme Court of the United States regarding military disability benefit division, post divorce.  The Supreme Court of the United States issued a unanimous decision, on May 15, 2017, overturning the Arizona Supreme Court.  See Howell v. Howell and Merrill v. Merrill.

The Berkshire Law Office, based in Phoenix, AZ is committed to helping our clients with all areas of family law, including divorce (dissolution of marriage), high net-worth divorce, legal separation, annulment, spousal maintenance, legal decision-making (custody)/parenting time issues, property division, orders of protection and pre-nuptial agreements.

In Family Court, or in the Court of Appeals, experience and knowledge of the law matters.  The Berkshire Law Office has been involved in some of the most groundbreaking appellate cases in Arizona including multiple cases at the Arizona Supreme Court and Court of Appeals.  The Berkshire Law Office also recently had a case accepted by the United States Supreme Court.  At the state level the decision in Volk v. Brame, argued at the Court of Appeals by Keith Berkshire, reasserted the constitutional protections for due process against artificially short hearings in Family Court.  The Volk decision will undoubtedly be cited to for the foreseeable future by Family Law Attorneys and litigants when trial courts try to restrict their time to present evidence.  This was a monumental win for the Berkshire Law Office and for Arizona family court litigants.

Keith Berkshire has handled divorce cases with estate values from the tens of millions of dollars, to cases where there was only debt to be divided; he has represented presidents of corporations and single parents with little income, as well as all of those in between.  Keith attempts to mediate most matters so his clients have more control over their final outcome and do not spend unnecessary attorney's fees. But when an equitable settlement is not an option, Keith aggressively pursues his client's interests in court and frequently utilizes experts for business valuations, legal decision-making (custody) evaluations, forensic accounting, tax implications, vocational assessments, real estate appraisals, and retirement account division.

Keith was selected for inclusion by Super Lawyers for inclusion on the Super Lawyers list for 2014, 2015, 2016, and 2017 and the Super Lawyers Rising Star List in 2012 and 2013. Keith was also named one of the Top 50 Lawyers by Super Lawyers in the State of Arizona, in all areas of practice, not just family law.  Keith is also rated as an  "AV Preeminent" attorney (the highest possible rating) by the attorney peer review process in Martindale-Hubbell®, the most widely known attorney peer review process in America.

Keith is also one of the very small group of family law attorneys in the state of Arizona admitted as Fellows to the prestigious American Academy of Matrimonial Lawyers.  The Academy is the most select group of family law attorneys in the county, with a rigorous selection criteria.

No matter the area of family law, the complexity or simplicity, the Berkshire Law Office can assist you in achieving the best possible outcome for your situation.
